HomeMy WebLinkAbout30-88 RESOLUTION RESOLUTION NO. 30-88 v i✓ A RESOLUTION SUPPORTING THE RESIDENCY REQUIRE- MENT IN THE RULES AND REGULATIONS OF THE FAYETTEVILLE CIVIL SERVICE COMMISSION. WHEREAS, §7 : 03 of the Rules and Regulations of the Fayette- ville Civil Service Commission provides: All members of the Fire and Police Department must reside within the area bounded by a circle which has a radius equal to the distance from the center of the downtown square to the most distant point in the City' s corporate limits plus one mile. Any members of the police and fire department whose residence was located outside such limit at the date of adoption of this regulation on May 29, 1975, shall be permitted to continue to reside at such residence. However, should any such person move from such residence, the new place of residence shall be within the required area. New appointees of the police and fire departments shall have six ( 6) months from the date of employment in which to locate within the required area. The Commission may extend this period in its discretion upon written request. and, WHEREAS, residency requirements for fire and police depart- ment personnel have been upheld by the courts; and WHEREAS, there has been discussion on repealing the residency requirement in the rules and regulations of the Fayetteville Civil Service Commission; and WHEREAS, the Fayetteville Board of Directors believes that said residency requirement promotes efficient fire and police protection. -2- NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: That the Board of Directors hereby supports the residency requirement prescribed by §7: 03 of the rules and regulations of the Fayetteville Civil Service Commission.
