A RESOLUTION AUTHORIZING APPROVAL OF A CHANGE
ORDER TO THE CITY' S CONTRACT WITH I .M.E. FOR
DELIVERY OF SLUDGE APPLICATION VEHICLES TO
EXTEND THE WARRANTY PERIOD.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
That the Board of Directors hereby approves a change order to
the City' s contract with I .M.E. for delivery of sludge application
vehicles to extend the warranty period authorizing the warranty
period for two sludge application vehicles to begin at the time of
start up and extending the completion time to 380 days. A copy of
said change order is attached hereto marked Exhibit "A" and made a
part hereof .

The following modifications to the contract are hereby ordered:
Extend the contract completion time days [from 180 days to 380 days, (to July 1, 1988)1
and the warranty period to be 1 year from start up of the vehicles which is estimated
to be about July 1988. j
This contract modification constitutes full and mutual accord and satisfaction for all
time and all costs related to this change. By acceptance of this contract modification, •
the contractor hereby agrees that the modification represents an equitable adjustment to
the contract, and further, agrees to waive all right to file any further claims or changes
arising out of or as a result of this change, or the accumulation of executed Contract •
Modifications on this Contract.
