BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF FAYETTEVILLE, ARKANSAS: Section 1. That the Board of Directors hereby authorizes the revision of a contract between the City and the Fayetteville Humane Society turning over to the Humane Society $15 ,600 of its 1987 budgeted funds for renovation of the existing Fayetteville Animal Shelter. Coates, Public Safety Director ow DATE: February 15, 1988 SUBJECT: Humane Society Contract Revisions The current contract between the City and the Fayetteville Humane Society has been found by our Accounting Division to lack the proper wording to permit the transfer of the renovation funds to Fayetteville Humane Society. Attached is a revised contract. Section #7 and Section #8 have been changed to reflect this transfer. The staff recommends the approval of this revised contract. The renovation of the existing animal shelter is a project that we need to continue. The present shelter will remain in use after the new one is built. The Humane Society and staff ask that these funds be authorized to be given to Fayetteville Humane Society so our renovation project can be completed. Projects Already Completed 1. Crematorium installed. 2. Privacy fence screening the crematorium. 3. Euthanasia room. 4. Water system. 5. Storm window installation. 6. Central heating furnace. Projects Yet to be Completed 1. The total of the proposed projects listed is $14,982.85. The renovation funds were approved by the Board of Directors and in the budget. Install a new heating system for the shelter with properly sized ductwork: to each space to be conditioned. Instead of air conditioning, install one 24" whole house ventilator in each large kennel area. These ventilators will have speed motors so the amount of air movement can be controlled by the person in charge. On high speed, the fans will provide about one air change per minute. On low speed it will provide one air change every two minutes. I have also f i gured a small exhaust fan and a make-up air fan for the euthanasia room. The installed cost for the heating system and the ventilation system is $2900. 00 + tax . This does not include possible electrical work for the ventilators. I hope that this is a reasonable propc,sal . I believe that these systems will accomplish what you folks want. I spent some time working on an estimate for an underfloor radiant heating system that would keep the animals warm at all times. Although this would be the ideal system for a kennel , I found that it would be cost prohibitive to install it at this time, since the society hopes to have a new bldg. in the next couple of years. The system would require covering the existing floor with another three inches of concrete. This plus the entire hot water heating system raises the cost well above the cost of the proposed heating system. In a new bldg. it would be more practical as it could be installed with the new floor. Thanks for the opportunity to work with you. Please call me if I can be of any help. S.x ncerel y. Bill Huber SCS cc: Di ck Johnson I 1 MICROFILMED AGREEMENT ‘77/This AGREEMENT executed this _ Rc3"" day of C� - , 198g. by and between the City of Fayetteville, Arkansas [the "City") ] and Fayetteville Humane Society, Inc. ("FHS"). WHEREAS, the City has adopted animal control ordinances which are codified as Chapter 4 of the Fayetteville Code of Ordinances; and WHEREAS, the City proposes to construct a new animal shelter; and WHEREAS, FHS has offered to assist the City in financing construction of a new animal shelter and has offered to serve as the the City's agent for the purpose of enforcing the City's animal control ordinances and operating the City's animal shelter. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS SET FORTH HEREIN the City and FHS hereby agree as follows: 1. FHS shall serve as the City's agent for the purpose of enforcing the City's animal control ordinances and operating the City's animal shelter. 2. FHS shall supervise the City's employees at the animal shelter. The City shall provide and pay the following employees: (a) A shelter director to be responsible for all shelter and animal patrol operations; [b) A shelter operator to be responsible for all animals in the City's custody and for maintenance of the animal shelter; and [c) Two animal control officers. 3. The shelter operator and animal control officers shall be under the supervision of, and report to. the shelter director. FHS may supplement the City's staff at the animal shelter with part time employees, volunteers, or individuals ordered by the Fayetteville Municipal Court to perform public service. Personnel matters relating to employees at the animal shelter shall be the responsibility of the City's Director of Public Safety and not FHS. FHS shall prepare annual performance evaluations for the shelter director, shelter operator and animal control officers. FHS shall also prepare annual goals and objectives for the operation of the animal shelter and animal patrol program. f 4. On or before the day of ,((h each year, FHS shall submit to the City's Director of Public Safety a proposed operating budget for the animal shelter and enforcement of the City's animal control ordinances. 5. FHS shall provide to the City's Director of Public Safety. a monthly report of all revenues and expenses at the animal shelter. On or before February 1st each year, FHS shall provide the City's Director of Public Safety with a report of all revenues and expenses for the preceding calendar year. 6. FHS shall be responsible for issuing and maintaining records for all animal licenses required by the City's animal control ordinances. 7. The funds budgeted by the City for the operation of the animal shelter division shall be paid to the FHS Shelter Account in twelve (12) equal installments, due the first day of each month. In addition, FHS shall be allowed to use all revenues generated at the animal shelter for the purpose of operating and maintaining said shelter and enforcing the City's animal control ordinances. Revenues generated by the sale of animal tags sold at locations other than the shelter, shall be remitted by the tenth [10th) of the following month to the FHS, to be placed in the shelter account. The City will turn over to the FHS the sum of $15,600.00 from 19B7 budgeted funds. $15,000.00 will be used by the FHS for renovation to the existing Shelter for items on the approved list. (See attached.) B. The City will make its best efforts to construct a new animal shelter west of the existing shelter site within three [3) years from the execution date of this agreement. Construction of said new animal shelter shall be financed from the following revenue sources.: [a) A contribution by the City of $50,000.00 per year for the years 1988, l989. and 1990: ' Page 2 CONTRACT CITY OF FAYETTEVILLE ANIMAL SHELTER/HUMANE SOCIETY (b) Contributions by FHS; and [c) Contributions by Washington County, Arkansas. (d) Annual Animal Shelter operating revenues in excess of operating expenses. 9. The City's contributions for a new animal control shelter shall be placed in an escrow account maintained by the City. If a new animal control shelter is not constructed within five (5) years from the execution date of this agreement. all moneys in said escrow account shall be returned to the City. Any disbursements from said escrow account must be supported by construction contract invoices. Construction plans for a new animal control shelter must be submitted to, and approved by, the City's Director of Public Works. 10. FHS shall have an annual audit performed by an independent auditing firm. A copy of this audit shall be submitted to the City within 30 days of completion. FHS shall require the audit firm to certify the amount of donations received for the shelter in the audit. 11. FHS shall insure that City employees do not perform animal control services beyond the City's corporate limits except on an emergency basis. 12. The term of this agreement shall commence on January 1, 1988, and shall terminate December 31. 1988. The term shall automatically be extended for terms of one [1) year each unless the City or FHS gives written notice of termination within thirty (30) days from the termination date.
