A RESOLUTION AUTHORIZING APPROVAL OF A CHANGE
ORDER TO THE CONSTRUCTION CONTRACT WITH HUBER,
HUNT & NICHOLS, INC. FOR THE WASTEWATER
TREATMENT PLANT PROJECT.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
FAYETTEVILLE, ARKANSAS:
The Board of Directors hereby authorizes the approval of a
change order to the construction contract with Huber, Hunt &
Nichols , Inc. for the Wastewater Treatment Plant project. A copy
of said change order is attached hereto marked Exhibit "A" and
made a part hereof .
PASSED AND APPROVED this 6th day of December , 1988 .

COMPLETION CONTRACTOR: Huber, Hunt & Nichols, Inc.
The following modifications to the contract are hereby ordered:
Investigate and repair leak to existing plant water
pipe $1,663 Phase II
Provide additional pavement base for existing
parking lot $5,539 Phase II
Provide credit for decreased size of 31 red maples ($1,705) Phase III
This contract modification constitutes full and mutual accord and satisfaction for all
time and all costs related to this change. By acceptance of this contract modification,
the Contractor hereby agrees that the modification represents an equitable adjustment to
the contract, and further agrees to waive all right to file any further claims or charges
arising out of or as a result of this change, or the accumulation of executed Contract
Modifications No. 21, No. 22, No. 23, and No. 24.
