RESOLUTION NO. 69-88
A RESOLUTION EXPRESSING THE FAYETTEVILLE BOARD
OF DIRECTORS' OPPOSITION TO ANY LEGISLATION BY
THE UNITED STATES CONGRESS WEAKENING LOCAL
LAND USE CONTROLS OVER THE SIZING OF BILL-
BOARDS AND REQUESTING THAT A PUBLIC HEARING BE
HELD ON THE FEDERAL HIGHWAY BEAUTIFICATION
ACT.
WHEREAS, the billboard industry has been working to undermine
the goals of the Federal Highway Beautification Act since the
adoption of said Act by Congress twenty-five years ago; and
WHEREAS, since last December, the billboard lobby has
attempted to attach a "billboard downsizing" amendment to four
different legislative initiatives; and
WHEREAS, the billboard industry is continuing its efforts to
gut local sign control ordinances; and
WHEREAS, the Fayetteville Board of Directors has adopted and
the City of Fayetteville has enforced a stringent sign control
ordinance which has been upheld by the Arkansas Supreme Court and
under which nonconforming signs were required to be removed
without payment of compensation; and
WHEREAS, the billboard industry' s proposed downsizing
amendment would preempt local zoning and force states and local
communities to pay the billboard industry millions of dollars in
public moneys before billboards could be reduced in size or height
( "downsized" ) to conform to local zoning laws and is being offered
without public hearings, participation or debate.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF FAYETTEVILLE, ARKANSAS:
Section 1 . That the Board of Directors hereby strongly
opposes any legislation in Congress which will weaken local land
use controls over the sizing of billboards, hereby urges Congress
to hold public hearings with public participation and debate on
any such legislation, and hereby urges Congress to hold a public
hearing on the Federal Highway Beautification Act.

Section 2. A copy of this resolution shall be forwarded
to each member of the Arkansas Congressional Delegation, to
members of the House Public Works Committee, and to members of the
Senate Environmental Public Works Committee.
