BACKGROUND:
The subject property is approximately '/4 mile east of the east of the City limits in Washington
County approximately 200 feet north of the intersection of E. Mission Blvd. and N. Oakland Zion
Rd. Containing approximately 4.66 acres, the property is undeveloped and is covered almost
entirely with tree canopy. Surrounding land uses and zoning are depicted in Table 1.

Proposal: The applicant intends to plat four residential lots with 1.06 acres, 1.02 acres, 1.296, and
1.29 acres. Having exhausted the number of administrative lot splits permitted from the parent
tract, this proposal is required to be reviewed as a concurrent plat. One variance was submitted
with the request:
• §166.05(A)(3) All lots in the planning area shall have direct frontage to a public
street, with the minimum frontage required by Washington County pursuant to
residential lot and block standards. The applicant has requested a variance from this
requirement for lots 3A and 4A, citing an allowance by Washington County code that
allows the lots to be accessed through a 30-foot access easement.
a. Staff recommendation: Staff recommends approval of the proposed variance. The
street frontage requirement is applied to lot splits because the creation of new
residential properties carries an associated potential to increase density and,
therefore, impact existing City services. Requiring residential properties to have
public street access in the Planning Area also facilitates the orderly integration of
properties into city limits, should they be annexed. N. Oakland Zion Rd. is a county,
neighborhood link street serving a large number of parcels and seven smaller
streets. The four proposed resultant lots are not appreciably different in
configuration when compared to the adjacent development pattern exhibited by
the neighboring properties, and a 30-foot access easement is proposed to be
dedicated with the lot split centered on the existing driveway. Further, the proposed
layout is less than % mile outside of city limits, at which point the proposed layout
would be administratively approvable under the tandem lot ordinance. Staff finds
the proposed is not likely to negatively impact the public interest. Staff
recommends an added condition that the shared driveway shall be paved from the
property line and/or master street plan right-of-way with asphalt, concrete, brick or
stone pavers, or other solid surface and shall extend a minimum of 18 feet (length)
into the property. The shared drive shall be installed prior to staff signature of the
plat for recording.
Water and Sewer System: No additional sewer infrastructure is required with this proposal; no
access to sewer is provided to properties outside of the City of Fayetteville limits. Due to two
parcels proposed below 1.5 acres, a letter from the Arkansas Department of Health is required
indicating approval of the overall plan for the utilization of either onsite wastewater systems or
individual septic permits prior to city signature.
There is currently a moratorium for new taps for water meter(s) for the use of irrigation and/or
services in this area for new subdivisions of land. Additional information is included in the attached
engineering memo. If approved, staff recommends conditions be added that notes be added to
the plat stating that water access shall not be available to city of Fayetteville water systems and
that the applicant shall provide documentation from Washington County, the Arkansas
Department of Health, and any other applicable agencies confirming access to water for all tracts
prior to city signature of concurrent plat for recording.
Right-of-way to be dedicated: The property in question has access to public street frontage on N.
Oakland Zion Rd., a county -maintained neighborhood link. A typical neighborhood link would
include 33.5 feet of right-of-way from the center line of the road. N. Oakland Zion Rd. currently
contains a mix of county right -of way (28.5 feet) and Fayetteville right -of way (13.5 feet)
immediately abutting each other, for a total of 42 feet of existing right-of-way from the center line.
Staff does not recommend any right-of-way to be dedicated with this development.

Street Improvements: Staff does not recommend any street improvements in association with this
request.
Tree Preservation: N/A; tree preservation requirements do not extend beyond the City of
Fayetteville limits.
Parkland Fees: N/A; parkland dedication requirements do not extend beyond the City of
Fayetteville limits.
Public Comment. Staff has received a couple of phone calls inquiring about the proposed
development. One caller expressed concerns about potential drainage and flooding in the area,
and the possibility of intensive development on the parcels.
RECOMMENDATION: Staff recommends forwarding CCP-2023-0002 to the full Planning
Commission, with the following conditions:
Conditions of Approval:
2. Subdivision Committee recommendation of right-of-way dedication. No right-of-way
dedication required.
3. Subdivision Committee recommendation of street improvements. No street
improvements required.
4. §166.08(E)(2) With the exception of corner lots, double -street frontage lots are
prohibited except where such lots front on access restricted roadways such as
expressways. Staff recommends in favor with added conditions:
a. Shared driveway shall be paved from the property line and/or master street plan
right-of-way with asphalt, concrete, brick or stone pavers, or other solid surface
and shall extend a minimum of 18 feet (length) into the property. The shared drive
shall be installed prior to staff signature of the plat for recording.
5. All remaining comments from City divisions, whether Planning or Engineering shall be
addressed prior to signature, including:
a. Prior to city signature, a letter from the Arkansas Department of Health is required

b. Notes regarding water access for tracts 3A and 4A shall be added to the plat per
the attached engineering memo.

Water: The subject property falls within a moratorium area, designated by the City of
Fayetteville Utility Director, in which new taps or meters solely for the purposes of

To Fayetteville City Staff:
Due to the historical strain of summer irrigation demands in the eastern portions of the City of
Fayetteville's Water System, an impending shortage of water exists. By the authority of the City of
Fayetteville Code of Ordinances Title V, Chapter 51.001— Water Shortages (attached), I do hereby
prohibit the installation of new taps or meters solely for the purposes of irrigation and for new taps or
meters for subdivisions of land. To further clarify:
• An exhibit of the subject area is attached to this document.
• An existing buildable lot with access to a public water main shall be allowed to install one
domestic water service for the construction of a single residence or business. If the waterline
has capacity issues aside from this moratorium, the tap may be denied for those reasons on a
case -by -case basis. An example is a dead-end, small diameter line, with many existing taps.
• Tap or meter requests for yard hydrants, irrigation -only hydrants, or any other use than a 5/8"
meter for a home or business will not be permitted until such time that the City completes
further capital improvements in the vicinity, approximately 2026.
• Homes or businesses that are allowed a new tap may not have a meter larger than 5/8" at this
time.
• The Water/Sewer Department has already been operating under this direction for more than
one year, however it seems prudent at this time to inform other city staff including the Planning
Division, Building Safety Division, and Utility Financial Services.

Mr. Curth,
We previously submitted a lot split application (LSP-2023-0033) to split parcels 001-15705-005
and 001-15705-006 into four lots for future single family residential construction. The property
is located along the west side of N. Oakland Zion Road approximately 350 feet north of Mission
Boulevard. The property is in the City of Fayetteville Planning Area in unincorporated
Washington County, Arkansas and is in the county's Agriculture/Single Family zoning district.
During Technical Plat Review, it was determined this needs to be resubmitted as a Concurrent
Plat because the original parent tract had already been split into several parcels.
Two parcels have less than the minimum public street frontage. Although Washington County
code allows this when a 30' private ROW is provided (30' access easement is provided on the
plat), staff have determined this lot configuration requires a variance of the minimum frontage
requirement provided in UDC 166.05(A)(3), which we hereby request.

several outbuildings. Surrounding land uses and zoning are depicted in Table 1.

Water and Sewer System: The site has access to City of Fayetteville water, but not sewer. No
additional water or sewer infrastructure is required with this proposal; each proposed lot will have
required access to water. No access to City of Fayetteville sewer is provided to Tract 1 or Tract
2.
Right-of-way to be dedicated: Right-of-way along E. Joyce Boulevard is 40 feet from the
centerline. E. Joyce Boulevard is a residential link street and the existing right-of-way exceeds
the Residential Link requirement of 26 feet from centerline. Accordingly, staff recommends no
additional right-of-way dedication is required. The Master Street Plan outlines a neighborhood link
connection through the property, but right-of-way dedication is not required.
Street Improvements: Staff does not recommend any street improvements in association with this
request.
Tree Preservation: N/A; no development is proposed at this time.
Parkland Fees: Parkland dedication fees in the amount of $1,089
Public Comment: Staff has not received any comments from the public on this item.

Narrative
Our client, David Knox, is requesting Concurrent Plat approval to split parcel 765-13237-005, a 31.86
acre parcel, into two tracts at 28.74 acres (Tract 1) and 3.12 acres (Tract 2) respectively.
Each proposed tract has more than the minimum amount of public street frontage and meets the
minimum lot standards for the R-A (Residential -Agricultural) zone in which it is located.
Easements for access and utilities are included in the request, to be dedicated per the plat (Blew # 23-
5889).
The addition of one lot at this location will not noticeably increase the traffic onto E. Joyce Blvd or N.
Crossover Rd.
Urban Forestry has stated that once a development request is made to the city a Tree Preservation Plan
will be required. But it isn't required at this time since the property owner is not making a development
request.

BACKGROUND:
The subject property is located in west Fayetteville, just south of W. Wedington Drive, about a
half -mile west of 1-49. The property contains roughly 2.11 acres and is in Planning Area 1 of the
Forest Hills RPZD. The property is currently mostly undeveloped except for a vacant single-family
dwelling constructed in 1993 which will be demolished. In 2020, the Subdivision Committee
approved LSD-20-7162, with conditions. Surrounding land uses and zoning are depicted in Table
1.

Right -of -Way to be Dedicated: No right-of-way dedication is required; Black Forest Drive and
Jewell Road are both private streets.
Street Improvements: Staff is not recommending any street improvements; Black Forest Drive
and Jewell Road are both private streets.
Access Management/Connectivity. Access to the site is proposed through two two-way driveways
along Black Forest Drive (a private drive). Cross access to the property to the east is provided by
two two-way access points. An access easement is provided to the west. Staff finds the proposal
meets the City's access management and connectivity standards.
Design Standards: This project is subject to compliance with the RPZD design standards
established by Ord. No. 5146 (6/30/2008). The project is also subject to §166.25, Commercial,
Office and Mixed Use Design and Development Standards. While EIFS is not permitted by
§166.25, it is a permitted material in the Forest Hills RPZD Planning Area 1. Staff finds that the
use of EIFS is appropriate for the subject property, and all other design standards outlined in
§166.25 are being met.
Water and Sewer System: The applicant is proposing to connect to an 8" water line on Black
Forest Drive. An 8" sewer extension is proposed to provide sanitary sewer to the property via an
existing utility easement.
Parkland dedication or fee in -lieu: N/A; commercial developments are not subject to parkland
dedication.
Tree Preservation:
Canopy minimum requirement: 25%
Existing canopy: 16.7%
Preserved canopy: 4.9%
Mitigation required: 38 2" caliper trees to be planted
Public Comment: To date, staff has not received any public comment on this item.

4. Conditions of approval from Engineering and Urban Forestry are included in the official
conditions of approval, attached hereto;
Standard Conditions of Approval:
5. Impact fees for fire, police, water, and sewer shall be paid in accordance with city
ordinance;
6. Technical Plat Review and Subdivision Committee comments (to include written staff
comments provided to the applicant or their representative, and all comments from utility
representatives: Black Hills Energy, AT&T, Ozarks Electric, SWEPCO, and Cox
Communications);
7. All mechanical and utility equipment (roof and ground mounted) shall be screened using
materials that are compatible with and incorporated into the structure. A note shall be
clearly placed on the plat and all construction documents indicating this requirement;
8. Trash enclosures shall be screened on three sides with materials that are complimentary
to and compatible with the principle structure. Containers may also be screened from view
of the street by the principal structure or vegetation. Elevations of the proposed dumpster
enclosure shall be submitted to the Planning and Recycling & Trash Collection divisions
for review prior to building permit;
9. All existing utilities below 12kv shall be relocated underground. All proposed utilities shall
be located underground;
10. Staff approval of final detailed plans, specifications and calculations (where applicable) for
grading, drainage, water, sewer, fire protection, streets (public and private), sidewalks,
and tree preservation. The information submitted for the plat review process was reviewed
for general concept only. All public improvements are subject to additional review and
approval. All improvements shall comply with the City's current requirements;
11. All exterior lighting shall comply with city ordinance. Manufacturer's cut -sheets are
required for review and approval prior to issuance of a building permit;
12. All freestanding and wall signs shall comply with ordinance specifications for location, size,
type, number, etc. Any proposed signs shall be permitted by a separate sign permit
application prior to installation;
13. Large scale development approval shall be valid for one year;
14. Contact the City's Emergency 911 Address Coordinator for addressing prior to building
permit;
15. Prior to building permit, a cost estimate for all required landscaping is to be submitted to
the Landscape Administrator for review. Once approval is gained, a guarantee is to be
issued (bond/letter of credit/cash) for 150% of the cost of the materials and installation of
the plants. This guarantee will be held until the improvements are installed and inspected,
at the time of Certificate of Occupancy; and
16. Prior to the issuance of a building permit, the following is required:

e. Project Disk with all final revisions; and
f. Completion of all required improvements or the placement of a surety with the City
(letter of credit, bond, escrow) as required by Section 158.01 "Guarantees in Lieu
of Installed Improvements" to guarantee all incomplete improvements. Further, all
improvements necessary to serve the site and protect public safety must be
completed, not just guaranteed, prior to the issuance of a Certificate of Occupancy.

Water: The applicant is proposing to connect to an 8" water line in W Black Forest Dr for
domestic water service and fire protection.
Sewer: The applicant is proposing an 8" sewer extension to provide sanitary sewer for the
property.
Natural Features: Hydric soils are shown to be present on site and are indicators of potential
wetlands. A wetland delineation must be provided at grading permit.
Drainage: Storm inlet design to be reviewed during grading permit process.
Street: Black Forest Dr is a private, dead end street with low speeds. There are numerous
locations proposed for this development that provide access to the site.
Plan Comments:
1. Information on the fire sprinkler system must be provided during grading permit review.
The max flow demand for the specific sprinkler system must be provided and will
determine the size of underground fire line. The underground line must be designed,
installed, and tested like a public water main.
2. Connection to the existing water main stub out may be revised based on in field
conditions. Instead of a tapping sleeve, a 45' bend may be able to be used.
3. Please shallow the sewer main to be as close to minimum cover as possible.
4. Profiles for the water main and fire line extension will be required at grading permit.
Standard Comments:
1. All designs are subject to the City's latest design criteria (water, sewer, streets and
drainage). Review for plat approval is not approval of public improvements, and all
proposed improvements are subject to further review at the time construction plans are
submitted.
2. Any damage to the existing public street due to construction shall be repaired/replaced
at the owner/developers expense
3. All public sidewalks, curb ramps, curb & gutter, and driveway aprons along this project
frontage must meet ADA guidelines and be free of damage. Any existing infrastructure
that does not conform to ADA guidelines or is otherwise damaged must be removed and

Forest Hills Partners, LLC is planning on developing Parcel Number 765-29416-003, located on West Black Forest
Drive. Blew & Associates, PA is submitting a Large Scale Development Plan for the Development of a Retail Center.
The Retail Center will include some restaurant capable space within the building. The site will also connect to the
drive stub outs provided from the Walmart Neighborhood Market lot to the east and create two connection points
to West Black Forest Drive (a local street). The proposed project meets the requirements of the PZD. We are not
